Always declare any fresh fruit and vegetables when crossing the border. At worst they will make you throw them out. At best they will let you keep them. As long as you declare you won't get into trouble.

If you don't declare and they catch you with them, that's when you could run into fines and big trouble. Smuggling produce isn't worth it.
