[[WXYZ) - With the clock still ticking down to Friday's deadline, Action News has learned from reliable sources close to the case that barring some unexpected developed as unlikely as winning the lottery, former mayor Kwame Kilpatrick will not satisfy the order to pay $79,000 in restitution by the end of the day tomorrow.
His position as we’ve learned it tonight: He will not pay because he cannot pay. We’re also told his lawyers believe he’s got a good point here, not that he won’t be in violation of an order to pay but that he deserves to be excused from the order because it’s money he doesn’t have—and nobody gets locked up for not paying what they don’t have to pay.

If Kilpatrick misses tomorrow's deadline to pay, the Corrections Department will inform the judge, probably on Monday, which will likely lead to additional hearings. Ultimately the prosecutors would have to show his present ability to pay now, never mind how much he had months ago. If they can prove that, then he’ll really be in trouble and perhaps subject to jail.

Also important to note: Kilpatrick's original sentence gave him give five years to pay back one million dollars. The only part set in stone was that he turn over 30% of his gross paycheck each month…and he’s always done that. The original order did not mention what he was required to with money he might win in the lottery or cash his friends may have given or loaned him, much less his wife and children.
