The Sixth Circuit, by a 2 to 1 vote, permitted the law suit about literacy in Detroit schools to move forward. That is,
plaintiffs from Detroit argued that the state supported a public school system in Detroit that did not ensure that students had a fair opportunity to become literate. The case was thrown out by the district judge but now has been reinstated by the Sixth Circuit. Will this matter eventually get to the Supreme Court? Does a state have to provide an elementary school system such that children have a fair and equitable change to become literate?
