"The Warren Police Department is completing an internal investigation into an alleged assault of a shoplifting suspect by the deputy police commissioner, who has been on unpaid administrative leave for months and has filed a federal lawsuit against the city and his boss.

"The Macomb County Prosecutor’s Office denied a criminal warrant authorization request for aggravated assault against Nichols from the county sheriff’s office, which was asked by Warren Police Commissioner Bill Dwyer in September to investigate.

"The request was denied Dec. 17 by an assistant prosecuting attorney, who wrote on the request “please handle internally,” according to documents obtained by the Free Press through a Freedom of Information Act request.

"The warrant authorization request stated that while in uniform, Nichols "punched the victim in the throat/neck while the victim was being placed under arrest for Retail Fraud." The victim was taken to an area hospital, where he was treated and provided pain medication, it states, and was diagnosed with having an anterior neck contusion."
