    Default Are You Keeping Up With The Case Of Judge King?

    School class goes on a field trip to court. One of the kids gets bored and sleepy. Judge throws a fit and cuffs the 15 year old. Claims 'tough love'.


    He's since been pulled from the bench and is now being sued.

    DETROIT [AP] — Attorneys for a teenager who was ordered into jail clothes and handcuffs during a field trip to a Detroit court filed a lawsuit against a judge Wednesday, accusing him of humiliation, false arrest and unlawful detention.

    It is the latest fallout since Judge Kenneth King singled out 15-year-old Eva Goodman for falling asleep and having what he considered to be a bad attitude while she was visiting 36th District Court on Aug. 13.

    King was removed from courtroom duties last week until he completes training, which hasn’t started yet.

    Post was too long to read,can you shorten it up to 3 words or less so I can comprehend it?

    Other then that,last time I went to court I wore a suit and the bailiffs mis took me for a lawyer because everybody else was dressed casually.

    It seems strange now,some judges will adhere to strict courtroom standards while others operate a more relaxed session.

    But seriously,if you are going to take a group of children into a court room,which should be considered a very serious ordeal,would you not at least school them on proper protocols and one of those would be no sleeping.

    You would not take little Johnny to the zoo and wait for the lion to eat him before you remind the brats it’s a good idea not to snuggle up with the lions.

    Was his message directed at that child or the way society in general has leaned more to disrespecting the system.

    Mom of teen handcuffed for sleeping in Detroit courtroom sues judge

    [The teen's mother, Latoreya] Till said she and her two daughters do not have a permanent home and are going back and forth between her mother's and her aunt's homes, which is why her daughter was sleepy in court.
    If the judge didn't know that, maybe he should have investigated further before jumping to conclusions. No harm was done until he acted.

    Just another straw in the continued downfall of Western Civilization... Kid gets yelled at for misbahaving, media jumps all over the "story", ambulance chasers show up for a big payday at the expense of general society and the taxpeyer, civil discourse continues to be the big loser.

    It's why teachers can't teach anymore, it's why the streets are covered in garbage, why shoplifters can run free without any thought of being stopped. Soon the left and lawyers will end qualified immunity and the police won't be able to aprehend a criminal for fear they might bruise them and get sued.

    The lesson for kids: if an adult punishes you, make as big a scene as possible, bait the adult into doing something that may be seen by some as going to far by some, call the lawers, and collect your check.

    I'm a big fan of court cam videos, and have gleaned a bit about court procedure from watching and listening to the lawyers commenting on various cases.

    1. Judges usually have quite a bit of leeway on how their courts are run, including ejecting disruptive observers
    2. This authority doesn't extend to everyone at all times, only to people in court when court is in session and, particularly, to those involved in the cases the judge is hearing
    3. It's kind of amazing on how differently judges run their courts. Generally rules are the same but the minutiae is different from judge to judge

    If a new lawyer is in front of a judge, the judge will give them a ten second shorthand spiel on how their court is run - "I'm easy" or "I have certain procedures" which is enough to let the lawyer know how to proceed.

    In any case, the judge was absolutely over the line in cuffing a girl who wasn't being disruptive. What wasn't clear from the news releases is if court was even in session or not. If it was, he does have leeway in ejecting or holding someone who was being disruptive, though there is a strong argument that sleeping isn't really disruptive.

    If court wasn't in session, he had absolutely no reason or authority to cuff and detain anyone being disruptive, and his behavior is even more egregious.

    Finally, the lawsuit is silly on it's face value. I guess you could argue the student was embarrassed or upset about being handcuffed, and you could stretch that into needing recompense. However, the lawsuit will go nowhere, as, if the judge had an active session, he is covered by absolute immunity, and if he didn't have an active session, he's covered by qualified immunity. Maybe the lawyer is hoping for a quick settlement to avoid embarrassment, but his lawsuit will go nowhere fast.

    The video post gives more insight then the media did.

    Court was not in session,this was a field trip to a court room as a mock up real life experience for the children.

    The kid fell asleep X 2 was called out X 2 sense it was posted the judge should have know the past history of the child,the teacher should have also and removed her or sat next to her after the first incident.

    So after the second warning the judge calls her out and has a mock trial of her peers ,no different then it would be in a real life court room and no different then how many scholars now disciplining disruptive kids in school all the way up to assault and rape.

    So if the goal of the field trip was to provide the kids a real life court experience,one might say they got it.

    Because that is exactly how it would have played out in many courts,I have seen judges lay into police officers waiting in the benches for nodding off,but after the first warning they do not do it again.

    To bring all of the homeless and rough things that the child is going through is wrong and presenting this once again in the court of public opinion outside of the facts.

    It’s a culmination of systematic failures and as in real life it ended up in front of a judge even if it was a mock trial,we do not know what the judge’s intent is other then he was there to provide to provide a real life mock trial and courtroom experience,which he did.

    Us older generations used to view children as the innocent ones needing protection,watch the news,there are 12 yo kids doing drive bys and mass theft in groups,beating up teachers,sucker punching innocent passersby’s etc

    If 60 is the new 50 it 12 is the new 18 yo.

    Intent - what was the judges true intent.

    Even like we see here in posts it is always about one’s personal feelings and expecting 350 million others to cater to them.

    According to the times now,I probably could have sued 7000 people by the time I hit 12 ,including the teacher that smacked my knuckles with a ruler and the teacher that gave me detention for falling asleep in class.

    I don't see a problem with what the judge did. Its not like he was locking the kid up and throwing away the key. Just provided some helpful reinforcement. Folks need to get over themselves.

    The way it is going I can probably go back 45 years and sue my old girlfriend that broke my heart and traumatized me against love,what jury would not award me millions?

    The message needs to be sent to all women,you just cannot go around breaking men’s hearts without repercussions what a better way to do that then with a massive monetary settlement.

    First have to set up a go fund me.

    Just keep in mind that aside from the civil suit, the 'Judge' is facing disciplinary action from the Court itself.

    I'm not sure if this is an elected position or not, but if it is, I hope the voters remember and vote him out.

    He is elected, which means he is protected from being fired over all but the most egregious reasons. If he took a bribe, for example, or showed a long term pattern of ignoring the law or proper court procedure.

    Where I am at the governor can remove elected judges and prosecutors and has been doing so for the reasons provided.

    These people are charged with enforcing established laws not with having the power to create them as they go along,that why we are seeing so much abuse going on.

    So they think they are above the law while judging and prosecuting others for breaking the law while they are breaking the law in the process,even worse spitting on the constitution in the process.
