    Default Nurse Arrested for Refusing Follow Police Orders.......

    So the officers arrive to collect blood sample from a victim of a crash. Nurse arrested because she refuses per policy? They had no warrant, nor was a warrant applicable? Ok........

    Thanks, Zacha341. I didn't know the patient himself was an officer until I read that.

    I'm left wondering why Officer Payne seemed to feel so confident that there would be no repercussions for his thuggery. It's pretty obvious the nurse committed no crime.

    I think there's more to this story than what we're hearing. Why was he so eager to get that blood sample? To "clear the name" of the patient just isn't enough of a reason.

    Story I get in bits and pieces is they were trying to find something on the driver/victim to clear the officers. They had engaged in a chase against city policy and after the crash, they figured they needed to try and find the other driver impaired somehow.

    Whether or not that's true may never be known for sure.

    I actually found an opined in the daily caller by a guy pretending to be a lawyer that puts the blame entirely on the nurse. It wasn't the article that kept me reading, the author compares apples and oranges, it was the comment section. It's comprised of mostly non trolls posting dozens of well thought out arguments and cites a variety of state statutes and case law.

    It's a worse situation than you think. If you watch the whole video, which some people have posted on Youtube, you can hear the arresting officer say much later, that he had forgotten that it is standard hospital procedure to draw blood and do a toxicological screen on all patients who come into the ER unconscious.

    So the entire ordeal was for absolutely nothing. All he needed to do was to get a search warrant for the existing test. Another blood test was not needed.

    You may still be inclined to cut him some slack, but he was on the special detachment of detectives that go to hospitals to get blood tests done. That's his JOB. He was incompetent enough to not know that you need a warrant to demand a blood sample, AND he had forgotten the simple fact that he didn't even need another sample taken.

    You can also hear him saying, later on, that in retaliation for giving him a hard time about following the law, he was going to drop off all the transients he finds at the hospital's ER.

    There might *still* be some extenuating circumstances here, but all evidence points to this guy being a piece of work, and he should not be a police officer anymore.

    He had no grounds to obtain a search warrant. There was zero reason to suspect that this unconscious man was under the influence of any substances considering that he was a victim of the crash, he did not cause it. To get a warrant, you have to articulate to a judge why you want to take someone's blood. Simply "because I'm curious to see what's in there" probably isn't going to pass legal muster.

    He was never going to get a judge to sign off on a warrant to get those original blood draws simply so this cop can go on a fishing expedition.

    He was a paramedic long before he became a cop. Once he got that badge, he dropped from full time paramedic work to part time. The comment was related to his part time job with an ambulance company. They didn't like the comment and fired him. So, he lost two jobs over this incident - or will have once the fussin' is done.
