    Default Charges dropped for three man who had been charged in a Detroit rape and robbery

    "The case has been dismissed for three man who had been charged in a Detroit rape and robbery last month.

    Antoine Orr, Jordan Reese and Chico Bruce were in court Tuesday morning for a preliminary hearing. The prosecutors stated that the accusors did not wish to pursue charges and did not wish to testify, and asked Judge Kenneth King to drop the case.

    All three were facing charges of criminal sexual conduct, kidnapping and armed robbery connected to the gang-style rape that happened on July 16 in the 10300 block of West McNichols Road. A man and woman in their 20s were walking when they had said they were approached by six men. They said one suspect pulled out a gun and forced them into an alley."

    If the DNA points to the suspect/suspects, what are the chances that prosecutors can bring and win a case, without victim testimony?
    After more consideration, and the fact that the charges were dismissed without prejudice, I suspect we may see these people in court again.

    If they have DNA then I'd say they have slam dunk case.

    It depends. That is called, at least by some, circumstantial evidence-based prosecution, and it is clearly more difficult to go forward without a victim witness. It is, in many domestic violence and gang-related cases where no one will testify, the best way forward. DNA evidence is the ultimate, as MSUguy says. If any existed, you could be sure the prosecutors would go forward.

    It's a shame that this is going away because no one will testify, and to make matters worse, the prosecutor didn't even have the leverage to get them to plea to something. Assuming it was them, this is gross.

    All three men had been identified as suspects shortly after the alleged incident happened. Orr and Reese were arrested, and Bruce turned himself in a few days later.


    Prosecutors are still working the case and DNA evidence is still pending.
    Our system of justice is byzantine from the outside. I think the news story is making a mountain out of a molehill. The actual, bare-bones story here, is that the victim is not collaborating with the prosecutors. There are countless reasons why that could be. In particular, our police, prosecutors, and adversarial idea of justice tend to be horrible to rape victims.

    Victims are generally asked to relate in exhausting detail a traumatic experience over and over again, and then hammered on subtle inconsistencies. Our brains process trauma in a lot of different ways, but often by being numb, distant, or unclear about details. Furthermore, being interrogated, testifying, and being cross-examined can all be extremely detrimental to healing.

    So all that hard work from Detroit 300 community police force for nothing!!!! If those three young black males aren't the gang rapers, then the real ones got away scott free. Live to gang rape again. In my theory they must have hide when the local news media snitched and after the Detroit Police made a false arrest of the preps [[even on turned himself in), the real gang rapers must have left town.

    You have remember the 90 percent of young black males in the United States can look like the boogyman. You can simply arrest any young black males just by looking their brown eyes and big lips without any solid proof. It's all about the color of your skin, not about the heart.

    Black lives matter, folks!

    This is America! free country. One Detroit black male turned himself in to proves his innocence. And he did. Lack of solid proof cause him and others to be set free. In the American justice system you're innocent until PROVEN guilty. Please see the U.S. Constitution. So the real gang rappers got away, left town, scott free. What a perfect crime!
