Capacity is a difficult call. The person has to be able to understand the full result and consequence of their actions. For whatever reason, both these boys sound like they are of diminished capacity by their attitude and statements. Creepy indeed, that there should be two like this, unrelated, in the same class. We would wish and hope this kind of madness were rare.

i remember people telling kids to stand up to bullies.
these kids took that advice too far.

maybe the advice from the parents and school should be simpler.
"hey kids, if you bully the wrong kid, he/she may find a gun and shoot your dumb ass"
