If Kilpatrick misses tomorrow's deadline to pay, the Corrections Department will inform the judge, probably on Monday, which will likely lead to additional hearings. Ultimately the prosecutors would have to show his present ability to pay now, never mind how much he had months ago. If they can prove that, then he’ll really be in trouble and perhaps subject to jail.

Also important to note: Kilpatrick's original sentence gave him give five years to pay back one million dollars. The only part set in stone was that he turn over 30% of his gross paycheck each month…and he’s always done that. The original order did not mention what he was required to with money he might win in the lottery or cash his friends may have given or loaned him, much less his wife and children.

In regards to the last statement, I believe the reason why the court is squeezing him is that before he started his restitution, he had do an audit of what assets he had. When he submitted his assets he failed to mention that he was going to receive a loan of 240,000 dollars. He was suppose to declare that money as future assets. The 50,000 dollars given to his by Moroun was clearly meant for him since Moroun didn't know the Mrs. If he was to hit the lottery or got another loan from someone else then yes that money would not factor in the restitution but you would think he would want to pay it down to reduce time remaining.

Personally I just wanted him to stay in Texas. Do not need him here to add cost to tax payers money.

Agreed, he's a "Texan" now and I'd like him to stay there. We don't him him hear to become more of a "martyr" on the tax payer dole, pontificating from a jail cell... He should now know the cheap always come out expensive. All the cries of being "indigent" has led to this.

He ain't goin' nowhere, jail or anywhere else.

And now the Feds on his back...

I think he'll beat Al Capone's jailtime. :)
