Anyone who was engaged in combat, yes. However, there appears to be questionable circumstances about many captured suspects, and that is what should be investigated to the fullest in a trial.
If even one person was wrongly captured or turned in unjustly for a reward, then America will have lost a little of her credibility, and claim of "liberty and justice for all".
