It is a stretch, and furthermore the private property owner would have to prove that the photos could or were published and put their property at risk. Very rare and difficult to prove, especially if the fence provides complete visibility from a public sidewalk.

They try to bundle it under reasonable expectation of privacy. For example, just because you are on a public sidewalk doesn't mean you can take photos through the window of a private residence.

Unless you are the paparazzi, I think most people with a camera know the limits of what is acceptable.
