    As long as you are on public property, you can photograph anything you want. There can be ordinances against photographing certain buildings, but I don't think they've ever held up in court, if you want to go that far.

    The only Detroit municipal code I could find is prohibiting commercial photography on the people mover, except for news coverage. [[58-7-22)

    I only had a problem once with some security ass in front of the Book Tower where I was just snapping amateur photos [[pre-911). Now that I am in DC, I see people get in trouble almost daily snapping photos for obvious reasons.

    The fence would be a REAL stretch, and what would add to the final determination, the company would have to show you were fully aware of a no photography policy they might have, and was that properly communicated to the photographer AHEAD of time.

    It is a stretch, and furthermore the private property owner would have to prove that the photos could or were published and put their property at risk. Very rare and difficult to prove, especially if the fence provides complete visibility from a public sidewalk.

    They try to bundle it under reasonable expectation of privacy. For example, just because you are on a public sidewalk doesn't mean you can take photos through the window of a private residence.

    Unless you are the paparazzi, I think most people with a camera know the limits of what is acceptable.

    I've done a "little photography" in my day......those images are superb.
